IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, JET'S PIZZA'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100.00) OR (B) THE TOTAL AMOUNT PAID BY YOU TO JET'S PIZZA IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Jet's Pizza and its affiliates, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, and successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

15. Dispute Resolution

15.1 Informal Resolution

We will attempt to resolve the dispute informally by contacting you within thirty (30) days of receiving your notice. 15.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except for disputes that qualify for small claims court and except as otherwise provided herein, you and Jet's Pizza agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Services (collectively, "Disputes"), will be resolved solely by binding arbitration on an individual basis. The arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org.

You understand that by agreeing to arbitration, you and Jet's Pizza are each waiving the right to a trial by jury or to participate in a class action or class arbitration.

15.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Jet's Pizza agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

15.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or other proprietary rights.

15.5 Small Claims Court

As an alternative to arbitration, if your dispute meets the jurisdictional requirements, you may assert your claim in small claims court in the jurisdiction where you reside or where Jet's Pizza operates, provided the matter remains in small claims court and proceeds only on an individual (non-class, non-representative) basis.

16. Term and Termination

These Terms shall remain in full force and effect while you use the Website or maintain an account with us. We reserve the right, in our sole discretion, to:

The rights and remedies provided in these Terms are cumulative and not exclusive of any rights or remedies provided by law.

These Terms, together with our Privacy Policy and any other legal notices or agreements published by us on the Website, shall constitute the entire agreement between you and Jet's Pizza concerning the Website and Services, and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Website and Services.
